  1. Acceptance of Terms

By accessing or using EyeWatch LIVE® services, you agree to be bound by these Terms & Conditions.

  1. Services Provided

EyeWatch LIVE® provides:

  • AI-powered monitoring 
  • Human-assisted observation (“Virtual Nurse Monitoring”) 
  • Fall detection and safety alerts 
  • Communication between users and monitoring personnel 

⚠️ IMPORTANT:
EyeWatch LIVE®  is NOT a medical provider and does not replace licensed healthcare professionals.

  1. No Medical Advice

All services:

  • Are for monitoring and support purposes only 
  • Do NOT diagnose, treat, or prevent medical conditions 

Always consult a licensed medical provider.

  1. User Responsibilities

You agree to:

  • Provide accurate information 
  • Use the system lawfully 
  • Obtain consent for monitoring where required 
  • Ensure proper device installation and usage 

  1. Consent to Monitoring

By using EyeWatch LIVE®, you acknowledge:

  • Video/audio monitoring may occur 
  • Individuals in monitored areas may be recorded 
  • You are responsible for notifying and obtaining consent where required 

  1. Emergency Services Disclaimer

EyeWatch LIVE®:

  • May assist in contacting emergency services 
  • May enable monitoring in the event of an emergency
  • Does NOT guarantee response times 
  • Is not responsible for emergency outcomes 

  1. Service Availability

We strive for 24/7 uptime but do not guarantee uninterrupted service due to:

  • Internet outages 
  • Hardware failures 
  • Force majeure events 

  1. Payment Terms

  • Services are billed monthly or per agreement 
  • Late payments may result in suspension 
  • Fees are non-refundable unless stated otherwise 

  1. Limitation of Liability

To the maximum extent permitted by law:

EyeWatch LIVE® shall not be liable for:

  • Injury, death, or damages 
  • Missed alerts or detection failures 
  • System downtime or interruptions 

Total liability is limited to fees paid in the prior 3 months.

  1. Indemnification

You agree to indemnify and hold harmless EyeWatch LIVE® from any claims arising from:

  • Improper use of services 
  • Failure to obtain consent 
  • Violation of laws or regulations 

  1. Intellectual Property

All content, software, and technology are owned by EyeWatch LIVE® and may not be copied or distributed without permission.

  1. Termination

We may suspend or terminate services if:

  • Terms are violated 
  • Payment is not received 
  • Misuse or illegal activity occurs 

  1. Governing Law

These Terms are governed by the laws of the State of Georgia.

  1. Changes to Terms

We may update these Terms at any time. Continued use constitutes acceptance.
